SUMMARY
Assists filers with the filing process, and in processing all Petitions for Protection from Abuse, Petitions for Protection from Sexual Violence or Intimidation and schedules all Indirect Criminal Contempt Petitions. Assist the PFA Supervisor and Family Deputy Court Administrators in the operation of the Family Division, as needed. This position requires the exercise of independent judgment and discretion and is of substantial importance to the Court. The nature of the work in this function is confidential and delicate.
ESSENTIAL DUTIES AND RESPONSIBILITIES
Petitions for Protection from Abuse are scheduled/processed. Walk-in Petitioners are interviewed and completed Protection from Abuse petitions are reviewed. The performance of this function requires the exercise of independent judgment and discretion, and requires a basic knowledge of legal standards (specifically the PFA Act) and their application in individual cases. Temporary Orders are received daily after ex parte hearing on the PFA petitions. New cases are entered to the scheduling system daily and Final hearing dates recorded. Weekly hearing lists are prepared for the Court.
Petitions for Protection from Sexual Violence or Intimidation are scheduled/processed. Walk-in Petitioners are interviewed and Protection from Abuse petitions are reviewed. The performance of this function requires the exercise of independent judgment and discretion, and requires a basic knowledge of legal standards (specifically the PFA Act) and their application in individual cases. Indirect Criminal Contempt charges (Violations of PFA or PSVI) are received daily and entered to the scheduling system. Scheduling Orders are prepared and weekly hearing lists are prepared for the Court.
The individual in this position is responsible for contacting the Child Advocacy Project regarding when Child Advocates are appointed and ensuring notification of any hearings/continuances. Video Conferences are scheduled or transport Orders are prepared for defendants in prison. Interpreters are requested for Final hearing when required.
The individual in this position communicates closely with Judges, chambers staff, attorneys, MCAP, Victim's Services, District Attorney, Public Defender and various other domestic violence agencies.
Dispositions are recorded and statistical reports are prepared. Monthly and annual statistical reports are prepared. Continuances are recorded in the scheduling system.
Assists Deputy Court Administrator - Family - in the operation of the Family Division, as needed. Answers questions based on information gathered by file review, computer review and/or experience. Emergency matters are directed for proper disposition. Again, the proper disposition of such matters requires a basic knowledge of legal standards and their application in individual cases.
Other duties as designated by the District Court Administrator.
Non-remote work required.
QUALIFICATION REQUIREMENTS
Education and Credentials
Paralegal Certificate preferred (not required), or other related field required, or an equivalent combination of education and experience may be substituted.
High School Diploma.
